Introduction:
At Brooder369, we are committed to protecting our users’ privacy and personal data in accordance with the Saudi Personal Data Protection Law and all related regulations. By using the platform, you acknowledge that you have read, understood, and agreed to these terms and conditions. If you do not agree, you are kindly requested not to use the platform.
Definitions:
The following words and phrases, wherever mentioned in this policy, shall have the meanings set forth beside each, unless the context clearly indicates otherwise:
- Service Seeker: A registered user on the Brooder369 platform — whether an individual, a private-sector entity, or a government organization — seeking to benefit from services offered by freelancers through the platform.
- Service Provider / Freelancer: A natural person who performs work and/or projects for the service seeker after approval.
- Service: Tasks or projects offered and sold through the platform by the service provider.
- Brooder369 Platform / The Platform: A digital intermediary platform under the trade name “Talent Incubator Trading Establishment”, with Unified Number 7039851006.
- Brooder369 Platform Administration: The Brooder369 team responsible for managing the platform.
- User: Any person registered on the platform to benefit from its services, including both service seekers and service providers.
Singular terms shall include the plural and vice versa, as the context requires. Headings and footnotes in this document are not to be considered in its interpretation.
User Account, Password, and Information Security:
- The username must be appropriate and meaningful; using symbols, numbers only, or offensive names is strictly prohibited.
- Prohibited names include — but are not limited to — impersonations, hate speech, profanity, or political, racial, or religious references, as well as trademarks or phone numbers.
- Users (individuals or entities) must choose a secure password and provide a valid email address for communication.
- The user is solely responsible for safeguarding their email and password. Any transactions made using their account will be their full responsibility, with no liability on Brooder369.
- (Exception: university-affiliated service providers may log in using university email credentials and define only a password.)
- The user is fully responsible for any content uploaded or shared via the platform.
- Users must not make agreements or conduct transactions with service seekers/providers outside the platform. Violation may result in account suspension.
Information Usage:
In addition to what is mentioned in the Privacy Policy, the information you provide or that we collect may be used as follows:
- With electronic payment service providers to process transactions.
- With third-party contractors for service development (while upholding confidentiality agreements).
- With our developers and engineers under strict protection measures.
- With authorized government authorities if required by law.
- With third-party support or hosting providers under data confidentiality agreements.
- With legal entities if required by a court order to settle disputes between users.
Data We Collect:
- Registration Data: (Full name, email, phone number, password, city, gender, etc.)
- Verification Data for Entities: Official documents (e.g., ID verification, commercial registration, authorization letter).
- Usage Data: Login history, added or purchased services, user preferences.
- Financial Data: Payment methods and transaction details.
- Any additional data voluntarily provided by the user.
User Data Protection:
- We apply technical and administrative security standards to protect data from unauthorized access, alteration, disclosure, or destruction.
- Sensitive data is exchanged through SSL encryption technology.
- Access to personal data is restricted to authorized staff and contractors.
- While we strive to protect your data, absolute security cannot be guaranteed, and you share data at your own risk.

- To enable users to access and use the platform.

User Rights:
According to the Saudi Personal Data Protection Law, you have the right to:

- Request deletion of your data if no legal reason exists to retain it.
- Withdraw consent for data processing (noting that this may affect service continuation).
Data Retention:
- We retain user data only for as long as necessary to fulfill its purpose or as required by Saudi law.
- Data may be retained to help recover accounts upon user request.
- Even after deletion, data may remain in backup systems for legal, tax, or regulatory reasons.
Amendments:
The platform reserves the right to amend this Privacy Policy at any time. Users will be notified via email or in-app alerts when significant changes occur.

Payment and Refund Policy
Payment:
- You can make payments through the secure electronic payment system available on the platform.
- The platform supports electronic payments via Mada, Visa, MasterCard, and licensed digital wallets within the Kingdom of Saudi Arabia.
- All payment transactions are secure and processed through licensed payment service providers.
Payment Completion:
- The service fee is collected in advance from the service seeker before the service begins.
- The amount is held by the platform until the service seeker confirms receipt of the service.
Refunds:
- The service seeker has the right to a full refund if the service provider does not start the service within the specified time period.
- The service seeker also has the right to a full refund if the service is canceled by the service provider.
- If the service is partially completed or does not match the agreed description, the dispute will be reviewed by the platform management, and the amount will be fully or partially refunded based on the evaluation.
- No refunds are allowed after the service seeker confirms receipt of the service.
Refund Duration:
Refunds are processed within 7-14 business days through the same payment method used for the transaction.
Fees and Currencies:
- The platform deducts a service fee (commission) from each successful transaction, along with Value Added Tax (VAT) on that commission.
- In the event of a refund, the refunded amount will be deducted by any applicable bank or payment provider fees, if any.
- The platform reserves the right to impose or modify fees and commissions after notifying users.
Dispute Resolution:
In the event of a dispute between the service provider and the service seeker, the platform management acts as a mediator to make a fair decision in accordance with the platform's terms, conditions, and policies.
